Thank you for using People-Match. By using People-Match, you agree to our Terms of Service, which is a legal agreement. If you are using People-Match for an organization, you are agreeing on behalf of that organization. Our Terms of Service apply to your use of our Websites and Services.

Legal Information

People-Match ("People-Match", "COMPANY," "WE," "US") provides this web site and all site-related services, including the content and code related thereto (collectively, the "site"), subject to your compliance with the terms and conditions set forth below. Please read this terms of use agreement ("agreement") carefully before using this site. By using the Site, you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, please do not use the Site.

This Agreement is made between the Company and you, the Site visitor and/or registered user ("you"). We reserve the right at any time to:

Change the terms and conditions of this Agreement;

Change the Site, including eliminating or discontinuing any content on or feature of the Site, restricting the hours of availability or limiting the amount of use permitted;

Change any fees or charges for use of the Site, including instituting new or increased fees or charges for the use of the Site or any other Site-related services or any feature thereof.

Any changes we make will be effective immediately upon notice, which we may provide by any means including, without limitation, posting on the Site or via electronic mail. Your use of the Site after such notice will be deemed acceptance of such changes. Be sure to review this Agreement periodically to ensure familiarity with the most current version. Upon our request, you agree to sign a non-electronic version of this Agreement. If you break any of your promises above or any of the rules in these Terms, we may terminate your account. Your actions may also subject you to legal consequences. As long as you comply with our Terms of Service, we grant you a non-exclusive, non-transferable, limited privilege to use People-Match. Your use of People-Match is at your own risk.

You must be at least 16 years of age to use the Site.

Intellectual Property

We own People-Match and our Services. You may not copy, reproduce, alter, modify, resell, mirror, or create derivative works of People-Match, our Services, or our content on People-Match without our written permission. You shall grant to us a royalty-free, worldwide, transferable, sub-licensable, irrevocable and perpetual license to incorporate into People-Match or otherwise use any suggestions, enhancement requests, recommendations or other feedback that we receive from you or your agents.

Warranty Information; Disclaimer

By using People-Match services, you confirm that you have obtained all necessary permissions, including from LinkedIn, for using People-Match with LinkedIn services, including permissions for copy, use, disclose or distribute any information obtained from LinkedIn. You agree that you will not use People-Match services if you do not have an explicit consent from LinkedIn for using People-Match and/or similar products with LinkedIn's service. Thus, People-Match holds no responsibility for inappropriate or illegitimate use of it's services. You agree that you will only use People-Match with LinkedIn profiles whose owners have granted you permissions to use, copy and store their LinkedIn profile data.

This site, including any content or information contained within it or any site related service, or any product or service licensed, purchased or otherwise made available through the site, is provided "as is" with no representations or warranties of any kind, either expressed or implied to the fullest extent permissible pursuant to applicable law, People-Match and its subsidiaries, affiliates, suppliers, sponsors, and agents disclaim all warranties, express or implied, including, but not limited to, the implied warranties of title, merchantability, fitness for a particular purpose and non-infringement neither its subsidiaries, affiliates, sponsors, suppliers nor agents makes any representation as to the results to be obtained from use of the site or the site-related services. People-Match and its subsidiaries, affiliates, suppliers, and agents will attempt to provide the best quality of service when possible, including concerns like availability, reliability and security, but do not warrant that your use of the site or the software will be completely uninterrupted, error-free, or secure. You acknowledge that you are responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed to access and use the site, and all charges related thereto. You assume total responsibility and risk for your use of the site and the software and your reliance thereon. No opinion, advice, or statement of People-Match or its subsidiaries, affiliates, suppliers, agents, registered users, or visitors, whether made on the site, or otherwise, shall create any warranty. Your use of the site and any materials provided through the site are entirely at your own risk. You acknowledge that the Site could include inaccuracies or errors. In case of insufficient amount of data or information in your personal Applicant Tracking system People-Match will not be able to guarantee the accuracy of the services provided. In the event that such a situation arises, please contact us at contact@People-Match.net with, if possible, a description of the material to be checked and the location (URL) where such material can be found on the Site, as well as information sufficient to enable us to contact you. We will try to address your concerns as soon as reasonably practicable. Limitation of Liability Neither People-Match nor its subsidiaries, affiliates, suppliers, advertisers, agents or sponsors are responsible or liable for any indirect, incidental, consequential, special, exemplary, punitive or other damages under any contract, negligence, strict liability or other theory arising out of or relating in any way to the site and/or content contained on the site, or any product or service purchased through the site. Your sole remedy for dissatisfaction with the site and/or content contained within the site is to stop using the site. We are not responsible for any inappropriate use of the People-Match Services which may result in damage, cause harm or violate any terms of use of any parties involved.

Service Functionality

You agree that service will be accessing and processing the data from your system (CRM or ATS). Processing data includes:

- Fetching data from the system

- Filtering and aggregation of data

- Inserting and updating records into the system

You also agree that the service will store the error and activity logs of your interactions with the service for debugging and billing purposes

Payment Terms

If you have a payment subscription. The free trial offer entitles new, registered users to 14 day trial of the Services. All fees are exclusive of all taxes or duties imposed by governing authorities. You are solely responsible for payment of all such taxes or duties. Monthly Plan: A valid credit card is required for you to continue using the Services on a month-to-month or year-to-year basis after trial period run out. The Services are billed in advance on a monthly or yearly basis and is non-refundable. There will be no refunds or credits for partial months, for account upgrades or downgrades, or for months unused with an open account.

We reserve the right to change service fees upon thirty (30) days notice. Such notice may be provided at any time by posting the changes to People-Match or by email.

Cancellation and Termination

You are solely responsible for the proper cancellation of your account. You may cancel your account at any time by sending us a message at contact@people-match.net. You will also have to remove the extension delivered from your browser. You will not be charged after cancellation. There is no cancellation fee. In the event of cancellation or termination your account will be immediately disabled, and your account and information cannot be recovered once the account is closed. We retain the right to retain or delete data provided to us by you at our sole discretion. We also reserve the right, but do not have any obligation, to refuse service to anyone and close your account(s) without notice for any or no reason at all.

Passwords and Accounts

You will be required to use your credentials which is associated with your account in your Applicant Tracking System. You will be responsible for the confidentiality and use of your password and agree not to distribute, transfer or resell your use of or access to the Site to any third party. If more than one individual wishes to use a single password belonging to a registered user, such registered user must request permission from the Company in writing, it being understood that the Company shall be under no obligation to approve any such request. You agree to notify us immediately of any unauthorized use of your account(s). We’re not responsible for any losses due to stolen or hacked passwords.

Indemnification

You agree to indemnify and hold us harmless from any and all demands, loss, liability, claims or expenses (including attorneys’ fees) made against us by any third party due to or arising out of or in connection with your use of People-Match.

Force Majeure

You agree that we are not liable for any delays or failure in performance of any part of the Services, from any cause beyond our control.

Entire Agreement

These Terms and all documents incorporated into these Terms by reference constitute the entire agreement between you and us and govern your use of People-Match, superseding any prior agreements between you and us (including, but not limited to, any prior versions of the Terms of Service).

Amendments and Changes to People-Match

We reserve the right, at our sole discretion, to change, modify, add, or remove portions of the Terms, at any time. Amendments or changes to these Terms won’t be effective until we post revised Terms on the Website. Unless explicitly stated otherwise, any new features that augment or enhance People-Match shall be subject to the Terms. It is your responsibility to check the Terms periodically for changes. Your continued use of People-Match following the posting of changes will mean that you accept and agree to the changes. We reserve the right to do any of the following, at any time, without notice to you: (1) to modify, suspend or terminate operation of or access to People-Match, or any portion of People-Match for any reason; (2) to modify or change People-Match, or any portion of People-Match, and any applicable policies or terms; and (3) to interrupt the operation of People-Match, or any portion of People-Match, as necessary to perform routine or non-routine maintenance, error correction, or other changes.
